Regulations for the sale of digital products

1 Definitions.

  2. Store - online sales service through which the Service Provider provides services electronically, including primarily the presentation of Products, placing orders, concluding Remote Agreements, conducted by the Seller at the Internet address https://kwartalnikfotografia.pl/shop/ 
  3. Product (interchangeably also used as Tredigital) - a file or files in digital form, in particular online courses, ebooks and other digital content not fixed on a permanent medium. 
  4. Tredigital - A file or files in digital form, not fixed on a permanent medium.
  5. Consumer - a natural person making a legal transaction with an entrepreneur (or a person engaged in unregistered activity) not directly related to his economic or professional activity.
  6. Przedsięconsumer rights recipient  - a natural person conducting a sole proprietorship who enters into an Agreement with another entrepreneur directly related to that business, but the Agreement does not have a professional character for that person, arising in particular from the subject of his business activity as disclosed in the Central Register and Information on Business Activity.
  7. Customer - a natural person with full legal capacity, a legal person or an organizational unit that is not a legal person, to which special regulations grant legal capacity, who intends to conclude or has concluded an Agreement for the provision of Electronic Services or a Sales Agreement.
  8. Contract - Agreement for the sale of Goods concluded between the customer and the Seller as part of an organized system of contracting at a distance, through the Store, without the simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication up to and including the conclusion of the Agreement.
  9. The contract for the provision of treśdigital (also used interchangeably as the Contract) - a Contract for the delivery of a Product concluded with the Seller through the Online Store, on the basis of which the Seller is obliged to deliver the Product to the customer, and the customer is obliged to pay the price for the Product to the Seller.
  10. Lead Magnet Supply Agreement (also interchangeably used as LM Agreement) - Agreement for the provision of Digital Content in exchange for personal data, the terms of which are described in the paragraph entitled "Lead Magnet", according to which the Seller provides the customer with Lead Magnet in exchange for the customer providing personal data in the form of name and e-mail address.

  12. Sales Agreementży - Agreement for the sale of a Product concluded between the Customer and the Seller through the Store.
  13. Dzień working - day of the week from Monday to Friday, excluding public holidays.
  14. Civil Code - Civil Code Act of April 23, 1964 (Journal of Laws 1964 no. 16, item 93 as amended).
  15. Law on śonsent of servicesłroadwaysą electronicą - Act of July 18, 2002 on the provision of services by electronic means (Journal of Laws No. 144, item 1204, as amended).
  16. Siłand youższa - is defined as an external event, impossible to foresee (which includes the slim likelihood of its occurrence in a given situation) and impossible to prevent (not so much the phenomenon itself, but its consequences) in particular fires, floods, earthquakes, volcanic eruptions, outbreaks of epidemics, as well as general strikes, riots, acts of war, terrorist acts, military coups. Also, certain actions of state authorities, such as blockades of state borders or the imposition of export or import bans.

2 General Provisions.

  1. These Regulations define, in particular, the terms and conditions of use of the Store, as well as the rights and obligations of the Seller and the Store's Customers.
  2. The Seller conducts sales through the Store at the following address https://kwartalnikfotografia.pl/shop/
  3. The seller conducts sales on the territory of Poland.
  4. Customers may communicate with the Seller in writing, electronically or by telephone (contact details as in section 1.1.1 of these Terms and Conditions), with orders being placed by customers in accordance with the procedure provided in section 5. of these Regulations. The Seller also allows contact through social media channels such as Facebook profilehttps://www.facebook.com/kwartalnik profile on Instagram https://www.instagram.com/kwartalnik_fotografia/. The Seller responds to sent inquiries during the Store's operating hours, i.e. from Monday to Friday from 10 am to 5 pm.
  5. The Seller, declares that it is not able to ensure that reviews of the Goods published on the store's website or the store's social media come only from consumers who actually purchased the Goods.
  6. E-books sold in the Store are available in PDF format.
  7. Digital content sold in the Store by its very nature does not need to be updated for compliance with the Agreement.

3 Rules of use of the store.

  1. Placing orders by the Customer for the Products in the Store's assortment is possible after providing the necessary personal and address data to complete the order.
  2. To use the Store, including browsing the assortment and placing orders for Products, it is necessary to meet the minimum technical requirements, such as:
    1. computer, laptop or other multimedia device connected to the Internet
    2. Web browser: Mozilla Firefox, Internet Explorer, Opera, Google Chrome, Safari, Microsoft Edge - updated to the latest versions
    3. active electronic mail (e-mail) account
    4. enable cookies and Javascript in your web browser
    5. recommended minimum screen resolution: 1024×768
  1. In the event that the Customer uses computer equipment or software that does not meet the technical requirements listed in Section 3.2. of the Terms and Conditions, the Service Provider does not guarantee the proper functioning of the Store and stipulates that this may adversely affect the quality of its electronic services.
  2. The Customer is obliged to use the Online Store in a manner consistent with applicable laws and the provisions of these Regulations. In particular, he/she is obligated to:
    1. to refrain from any activity that could affect the proper functioning of the Store, including, in particular, from any interference with the content of the Store or its technical elements,
    2. not to provide or transmit content prohibited by law, including, in particular, offensive or vulgar content, incitement to violence or other actions contrary to the law or good morals, or that violate the personal rights and other rights of third parties,
    3. use any content posted on the Store solely for your own personal use,
    4. Use of the Store in a manner that is not onerous for other Customers and for the Seller.
  1. In case of violation of these Terms and Conditions by the Customer, in particular by violating the provisions of Section 3.4. of the Terms and Conditions, the Seller may deprive the Customer of the right to use the Store, as well as may restrict his access to part or all of the resources of the Online Store, with immediate effect.
  2. The information provided by the Customer in the course of order placement should be truthful, up-to-date and accurate. The Seller reserves the right to refuse to execute the order in case the data provided makes it impossible to execute the order, in particular, prevents the proper delivery of the Goods. Before refusing to process the order, the Seller will attempt to contact the Customer in order to establish the data to the extent that the order can be processed.
  3. The Service Provider has the right to organize occasional promotions, the terms and conditions of which will be stated each time on the Store's website. Promotions are not cumulative, unless the Terms and Conditions of a given promotion state otherwise.

4. electronic services.

  1. The Service Provider provides free of charge and voluntary services by electronic means, consisting of browsing the information posted in the Store, providing a form to place an order for products and also using the contact form, creating a user account.
  2. The order form service consists in enabling Customers to place orders for products offered by the Seller through the Store's website, in accordance with the procedure provided in section 5. of the Regulations. The service is provided free of charge and is of a one-time nature. The service is terminated immediately after the order is placed.
  3. The Contact Form service involves sending a message to the Seller using a form on the Store's website. Cancellation of the above service is possible at any time and consists in ceasing to send inquiries to the Seller.
  4. User's Account service, consisting in the establishment and maintenance of an Account in the Store, is provided free of charge for an indefinite period of time. The Account stores the Buyer's data and the history of orders placed by the Buyer in the Store. The Buyer logs into the Account using his e-mail address and a password defined by him. The Client may delete his/her account at any time, without giving any reason and without incurring any costs by sending a relevant request to the Service Provider in writing, or by e-mail. 
  5. The Services indicated in Section 4.1 are provided by the Service Provider 24 hours a day, 7 days a week.
  6. The Seller makes every effort to ensure that the services provided by the Store are at the highest level, however, the Seller does not exclude the possibility of temporary suspension of the availability of the Store, in particular in case of the need for maintenance, inspection, the need to modernize or expand the Store.
  7. To the fullest extent permitted by law, the Service Provider shall not be liable for disruptions in the delivery of electronic services, including interruptions in the operation of the Store caused by force majeure, unauthorized acts of third parties or incompatibility of the Online Store with the Client's technical infrastructure.
  8. Complaints about services provided electronically may be submitted in writing, or by e-mail (contact information indicated in section 1.1.1. of the Regulations). In the complaint, the Client should provide his/her name, mailing address and the type and date of the irregularity related to the services provided by the Service Provider. Complaints will be considered by the Service Provider within 14 days.

5 Intellectual property.

  1. The Seller informs that the Digital Products offered by the Seller are works in

  2. The customer agrees to respect the Seller's copyright and to use the

6 Purchasing rules.

  1. The Customer may purchase a Product from the Store's assortment by submitting a
    orders. The customer places an order after providing the necessary personal information to enable
    implementation of the order.
  2. Orders can be placed 24 hours a day, 7 days a week.
  3. The customer selects the Product on sale at the time of placing the order,
    according to its description and price, and specifying its quantity. The customer completes the order by taking

    communications and information available on the Site.
  4. In the course of placing an order - up to the moment of pressing the "Buy and pay" button - the customer has
    the possibility of modifying the order, in particular with regard to the choice of goods and their quantity

  6. In order to send an Order, it is necessary to accept the content of the Terms and Conditions, to provide
    personal data marked as mandatory and clicking the "Buy and pay" button.
  7. Upon effective payment, the following is concluded between the Customer and the Seller
    contract for the delivery of digital content. Confirmation of purchase will also be sent to the email address provided in the order form.
  8. The Seller will deliver the Product to the Customer as soon as it receives confirmation that the Product has been made
    full payment by the Customer. The Product purchased by the Customer will be delivered to the Customer in
    manner and within the timeframe indicated in the description of the Digital Product in question. In the event that the Customer does not

  9. A non vat invoice is issued for each order. It is delivered electronically
    to the e-mail address indicated in the ordering process. Acceptance of the Terms and Conditions constitutes
    at the same time agree to send (share) invoices in electronic form. The indication by
    Customer data for invoice without VAT in the form of taxpayer identification number and sole proprietor company

7 Payment.

  1. Orders placed in the Store can be paid for:
    a. in advance (before collection of the subject of the order) - paid directly to the account
    Seller's bank through the Przelewy24 system (electronic transfer
    or payment by credit card: Visa, Mastercard, Maestro)
    b. in advance - by traditional bank transfer to the Seller's bank account
  2. The seller is entitled to cancel the order if the customer fails to pay in full
    payment within 5 working days from the date of receipt by the customer of the confirmation of submission
    order (concerns payment by traditional bank transfer). Cancellation of the order means that
    The vendor is exempt from the obligation to implement it.
  3. Settlement of payment card and e-transfer transactions is carried out through the
    Przelewy24 Settlement Center. These services are provided by PayPro S.A., headquartered at ul.

8 Price.

  1. The price of the Product is given in Polish zloty and includes the value added tax (price
    gross).
  2. The seller reserves the right to make changes to product prices on an ongoing basis.
    This entitlement does not affect the value of an order placed before the date of the price change.

9. complaints of goods (warranty).

  1. The Seller shall be liable to the Customer who is a Consumer for physical or legal defects
    Goods under Article 556 et seq. of the Civil Code.
  2. The seller shall, within a period of two years from the receipt of the goods by the consumer, bear the
    warranty liability for physical and legal defects in the goods. In the case of a physical defect
    The goods do not have the characteristics that they should have due to the purpose specified in the contract, or
    resulting from the circumstances or purpose, or was delivered to the buyer in an incomplete condition
    and other defects specified in Article 5561 of the Civil Code. A legal defect occurs when
    The goods are the property of a third party or are encumbered by the right of a third party.
  3. In the event of a defect in the goods, the Consumer has one of the following rights against the Seller
    The following complaint claims:
    (a) to make a declaration of withdrawal from the Contract (the Consumer cannot make a declaration of
    withdrawal from the contract if the defect is insignificant.),
    (b) demand a reduction in the price of the Goods, unless the Seller immediately and without excessive
    inconvenience to the Consumer will replace the Goods with defect-free ones or remove the defect,
    (c) request to replace the Goods with defect-free Goods,
    (d) request for removal of the defect.
  4. A claim for the removal of a defect or replacement of goods with defect-free goods is time-barred by the expiration of the
    One year, counting from the date of discovery of the defect.
  5. Complaints can be submitted in any form, to the contact information provided in Section 1.1.1.

  8. In accordance with Article 558 § 1 of the Civil Code, the Seller disclaims liability under warranty
    in relation to Customers who are not Consumers and in relation to Entrepreneurs on the
    consumer rights.
  9. Any disputes arising between a Customer who is not a Consumer and the Seller,
    shall be settled by a court with local jurisdiction over the registered office of the Seller.

10 Right of withdrawal.

  1. A customer who is a Consumer and also an entrepreneur on the rights of a Consumer has the right to withdraw
    From the contract within 14 days without giving any reason. Running of the period for withdrawal from the Agreement
    Starts from the moment of payment of the Order. Section 10.2 shall apply.
  2. In the case of Digital Products, if the Consumer or Entrepreneur by rights
    The consumer will request performance (delivery of digital content in the form of a Product)
    before the expiration of the deadline for withdrawal from the Agreement, he will thereby lose the right to
    withdrawal from the contract. Thus, the customer retains the right to withdraw from the contract if he does not
    downloads digital content (or does not otherwise start using it, for example, through
    start of the online course) before the expiration of 14 days after payment of the order, only
    after that date.
  3. Performance is understood as the first act performed by the Consumer or the
    Entrepreneur on the rights of the consumer, which leads to the possibility of lawful familiarization with the
    content of the Product. This action may consist, in particular, in logging into the Account, downloading,
    sending, shipping, displaying, opening the Product and also confirming the purchase of the Product orally,
    by telephone, e-mail or any other method that involves making declarations of intent on the
    Distance.
  4. The customer, entitled to withdraw from the contract, exercises this right by sending the appropriate
    statements in any form including, but not limited to, to the address of the Seller's registered office or by means of a

  5. The seller shall immediately send the customer an acknowledgement of receipt of the withdrawal notice

  7. Seller, not later than 14 days from the date of receipt of the statement of withdrawal from the

11 Out-of-court ways of dealing with claims investigation.

  1. The Seller informs that the Customer who is a Consumer is entitled to use the
    Out-of-court means of redress in accordance with the procedure of Internet Settlement

  2. The seller agrees to submit any disputes arising in connection with the conclusion of the
    Agreement with the Seller through mediation proceedings. The details will be determined by
    parties to the conflict.

    and entrepreneurs at the EU level, which is an interactive and multilingual site

  4. Consumers can get free help on their rights and on a dispute
    between him and the Seller, among other things, by applying to the district (city) Ombudsman
    Consumers or a social organization whose statutory tasks include consumer protection
    (among others, the Federation of Consumers, the Association of Polish Consumers) as well as addressing the
    Permanent amicable consumer court with a request for dispute resolution. Information for
    Consumers, including information on how to get help, including information on
    Entities authorized to handle disputes out of court (in particular Ombudsmen
    Consumers or Provincial Inspectorates of Trade Inspection) are also available on the website.

12 Personal Data Security.

  1. The controller of personal data processed in connection with the implementation of the provisions of the

13 Final Provisions.

  2. The Seller reserves the right to change or update these Terms and Conditions. To contracts
    concluded before the amendment of the Regulations, the version of the Regulations in force on the date of submission shall apply
    order by the customer.
  3. In matters not regulated in the Regulations, the applicable legal regulations shall apply
    Polish, including in particular the Civil Code, the Act on Providing Electronic Services and the
    other relevant provisions of generally applicable law.
  4. These Regulations are effective as of 02.05.2022.

1 Definitions

  1. The terms used in these regulations mean:

  6. Customer - natural person with full legal capacity, legal person
    or an organizational unit that is not a legal person, to which special regulations grant
    legal capacity, which intends to conclude or has concluded a Service Agreement
    Electronic or Sales Agreement.
  7. Contract concluded at a distance - The contract concluded with the customer under the organized
    system of concluding contracts at a distance, through the Store, without simultaneous
    physical presence of the parties, with the exclusive use of one or more means of
    of remote communication up to and including the conclusion of the Agreement.

  9. Sales Agreement - contract of sale of the Product concluded between the Customer and the Seller for

    meets the technical requirements listed in section 3.2 of the Terms and Conditions, the Service Provider will not

  4. The customer is obliged to use the Online Store in a manner consistent with the
    applicable laws and the provisions of these Regulations. It is
    obliged in particular to:
    (a) refrain from any activity that could affect the proper
    functioning of the Store, including in particular from any interference with the content of the
    Store or its technical elements,
    (b) not to provide or transmit content prohibited by law, including in

    actions that are contrary to the law or good morals, or that violate personal rights and

  5. In case of violation of these Regulations by the Customer, in particular by

  6. The information provided by the customer in the course of placing an order should be truthful,
    up-to-date and accurate. The seller reserves the right to refuse an order in
